Sbaya Mobile (“we”, “us”, “our”) respects your privacy and is committed to protecting your personal information. This policy explains what information we collect, why we collect it, how we use it, and the rights you have over it, in line with South Africa’s Protection of Personal Information Act (POPIA).

Who we are

Sbaya Mobile is a direct-import iPhone retailer based at 216 Stalwart Simelane St, North Beach, Durban, 4001, South Africa. For any privacy-related question, contact us at orders@sbayamobile.com or 068 422 2998.

Information we collect

We collect information you give us directly, and some information collected automatically when you use our site:

  • Order and account information: name, delivery address, email address, phone number, and order history, when you place an order or create an account.
  • Payment information: we do not store your card details. Payments are processed directly by PayFast or Float, our payment providers, under their own security and privacy terms. We only receive confirmation that payment was made and a reference number.
  • Communications: messages you send us via our contact form, email, phone, or WhatsApp, including any details you share when asking about an order or product.
  • Newsletter and marketing: if you sign up for offers or updates, we collect your email address and, where provided, your phone number, through our email service provider.
  • Technical information: standard web log data (IP address, browser type, pages visited) and cookies used to keep your cart working and to understand how visitors use our site.

How we use your information

  • To process and deliver your order, including sharing your name, address, and phone number with our courier partner (The Courier Guy) solely for delivery purposes.
  • To communicate with you about your order, respond to enquiries, and provide customer support.
  • To send marketing communications, only if you have opted in, and you can unsubscribe at any time.
  • To improve our website and product range based on how our site is used.
  • To meet our legal, tax, and accounting obligations.

Who we share information with

We do not sell your personal information. We share it only where necessary to run our business:

  • Payment providers (PayFast, Float) to process your payment.
  • Courier partners (The Courier Guy) to deliver your order.
  • Email service providers (Brevo) to send order confirmations and, if you’ve opted in, marketing emails.
  • WhatsApp/Meta, if you choose to contact us via our WhatsApp chat button — that conversation is subject to WhatsApp’s own privacy terms.
  • Service providers who help us run our website and business operations, bound to keep your information confidential.
  • Law enforcement or regulators, only where legally required.

Cookies

Our site uses cookies to keep your shopping cart working between pages, remember your preferences, and understand how visitors use the site. You can disable cookies in your browser settings, though some parts of the site (like checkout) may not work properly without them.

How long we keep your information

We keep order and account information for as long as needed to fulfil our legal obligations (including tax and consumer protection record-keeping), resolve disputes, and enforce our agreements. Marketing information is kept until you unsubscribe or ask us to delete it.

Your rights under POPIA

You have the right to:

  • Ask us what personal information we hold about you.
  • Ask us to correct inaccurate or outdated information.
  • Ask us to delete your personal information, subject to our legal obligations to retain certain records.
  • Object to how we use your information, including opting out of marketing at any time.
  • Lodge a complaint with South Africa’s Information Regulator (inforegulator.org.za) if you believe your information has been misused.

To exercise any of these rights, contact us at orders@sbayamobile.com.

Security

We take reasonable technical and organisational measures to protect your personal information against loss, misuse, and unauthorised access. No system is completely secure, and we encourage you to also take care with your own account details and passwords.
